Terms & Conditions
All goods and services sold by us to you are sold on the terms and conditions set out below. We may, at any time, vary these terms and conditions. These terms and conditions may not otherwise be varied unless agreed by us in writing.
In these terms and conditions, references to "we", "our" or "us" are references to bubandboo, references to “the Website” is a reference to https://www.bubandboo.com.au and references to "you" and "your" are references to the customer.
While we endeavor to supply accurate information on this site, errors and omissions, may occur. We do not accept any liability, direct or indirect, for any loss or damage which may directly or indirectly result from any advice, opinion, information, representation or omission whether negligent or otherwise, contained on this site. You are solely responsible for the actions you take in reliance on the content on, or accessed, through this site.
You will be deemed to have read and accepted these Terms and Conditions when you confirm an order for goods or services by clicking on the "Complete Order" button.
Once your order has been accepted by us this will constitute a binding contract for the supply of the goods or services on these Terms and Conditions.
REFUSING OR CANCELLING ORDERS
In the unlikely event that the goods or services ordered are no longer available, we reserve the right to refuse or cancel an order.
While we endeavor to ensure that the price and description of goods or services is accurate, if there is an error in the process of listing a product or service on our website, or a technical error in the processing of your order, we reserve the right to refuse or cancel the order.
We hold the right to refuse or cancel an order if a technical error occurs beyond our control.
Our right to cancel orders applies to orders that have been accepted.
PRICE AND PAYMENT
We will make every effort to ensure our prices are current and up to date. We reserve the right to change our pricing without notice. All orders processed will be granted at the purchase price listed at time of purchase.
All pricing listed is charged in Australian Dollars (AUD) and includes relevant taxes.
FREIGHT AND HANDLING
You will pay freight and handling charges on any goods you order from us as follows:
All goods delivered incur a freight and handling charge subject to the value of the order.
- For orders up to $120.00, a variable rate shipping charge will be applied at checkout depending on order value, destination and shipping services selected by the customer where applicable.
- For orders $120.00 or more, delivery will be free.
All re-shipments due to incorrect address or non-pickup will be charged a flat rate shipping and handling fee of $10.00 for Australian domestic shipments and $25.00 for International deliveries.
ORDER AND DELIVERY
Orders placed before 5pm Mon-Fri AEST on in-stock items will be dispatched the next business day. Orders placed over the weekend or on public holidays will be shipped on the next business day.
We will deliver anywhere within Australia using Australia Post's Express or Standard delivery services. Goods sent by Express services will generally be delivered next business day and goods sent via Standard services will be delivered within 2 - 7 business days from the time they leave our warehouse and will arrive on normal business days only. We do not offer deliveries on weekend or public holidays. Delivery may be delayed during sale or promotional periods.
You will be sent a tracking number as soon as your order has left our warehouse so that you can track your order to your front door.
If we anticipate that you will not receive the goods within that time we will advise the reason for the delay and the likely date of the delivery. You will then be asked to confirm the order or cancel the order.
Please ensure that you have provided the correct shipping address to us, any cost associated with reshipping of returned goods due to incorrect address will be your responsibility.
A signature may be required when your order is delivered and as such we recommend that you provide a delivery address where someone will be available to receive your order. If no one is available at time of delivery Australia Post will leave a card in your letter box advising you to collect your delivery from your local post office.
While we do everything we can to ensure your order is delivered in a timely manner, we will not be liable for any loss or damage incurred by any person as a result of delay, loss or damage to a shipped order caused by our carrier that we have no control over, or by any event which is out of our reasonable control or foresight including, but not limited to, any delay caused by an incorrect delivery address being provided to us.
We use Australia Post's International delivery services for overseas shipments, typically parcels will be delivered within 6 - 10 business days from the time they leave our warehouse.
PROPERTY AND RISK
Property and risk in goods ordered by you from us will pass to you upon delivery of the goods to your specified delivery address for the relevant order.
REFUND AND EXCHANGES
We endeavour to provide you with exceptional products, however if your item is faulty or you are unhappy with your purchase due to colour, sizing or simply didn’t meet your expectations, please contact us within 14 days of receipt of your parcel and we will arrange a refund or exchange to the same value.
If an item is faulty we will happily replace the item or refund the item’s value including shipping costs, however shipping will not be refunded if there are other items listed on the invoice when a faulty item is returned.
Faulty goods must be returned to us as soon as possible.
Freight charges will not be borne by you if you are located within Australia.
If you are located outside Australia and you wish to return faulty goods to us (for repair or otherwise), then, to the fullest extent permitted by law, you will be responsible for the freight and handling charges associated with:
- returning the goods to us; and
- delivering any repaired or replacement goods back to you.
We will advise you of the freight and handling costs associated with returning repaired or replacement goods to us in such circumstances and the repaired or replacement goods will not be sent to you until you have confirmed that you will pay the freight and handling costs.
No refunds or exchanges will be granted outside the 14 day period once item once item is received.
It is the customer’s responsibility to ensure that they have read the terms and conditions prior to making a purchase.
To make a return please contact us at email@example.com and provide your name, invoice number, product name, reason for return and request for replacement, exchange or credit, BEFORE sending the parcel back, we will provide you with the delivery address and we will arrange to exchange or refund your payment after inspection of the goods. All returns made without authorisation will not be accepted.
No refunds or exchanges to sale items, discounted items purchased using a promo code or underwear/swimwear items (for hygiene reasons), will be given, unless they are faulty.
If your item is damaged upon delivery, please contact us as soon as conveniently possible to discuss a suitable resolution.
We will make every effort to ensure that our products are described and illustrated accurately on our website, and will provide the most accurate images to reflect the true colours of your item purchased.
If you are unhappy with your purchase due to incorrect description or colour discrepancy, our 14 day return policy applies. No refund will be granted outside of the 14 days.
We cannot be responsible for any delays or interruptions to the Website. We will use commercially reasonable efforts to minimise delays and interruptions. However, we cannot warrant that the Website will be available at all times or at any given time.
We may at any time and without notice to you, alter or discontinue the Website in whole or in part. However, we cannot be responsible for any loss, cost, damage or liability that may result from our alteration or discontinuance of the Website.
In relation to the Website, you must not:
- use the Website for any activities or post or transmit via the Website, any information or materials which breach any laws or regulations, infringe a third party’s rights, or are contrary to any relevant standard or codes;
- use the Website to post or transmit any material which interferes with other users or defames, harasses, threatens, menaces, offends or restricts any person or which inhibits any user from using the Website or the Internet;
- use the Website to send unsolicited email messages;
- in any way tamper with, hinder or modify the Website;
- knowingly transmit any viruses or other disabling features to the Website or via the Website; or
- attempt any of the above acts or facilitate or assist another person to do any of the above acts.
The material on the Website, including the software, design, text, images and graphics comprised in the Website and the selection and layout of the Website are owned or under license by bubandboo and protected by Australian and International laws.
Your use of the Website does not grant you a licence or act as a right of use of any of the trade marks or logos, whether registered or unregistered, that are displayed on the Website without the express written permission of the trademark owner.
You may view the Website and its contents using your web browser. In visiting the Website, you may make a temporary copy of the Website by means of the usual operation of your web browser only

In the case of services supplied or offered by us:

- the payment of the cost of having the services supplied again.
In the case of goods supplied or offered by us:
- the replacement of the goods or the supply of equivalent goods;
- the repair of such goods;
- the payment of the costs of replacing the goods or acquiring equivalent goods; or
- the payment of the costs of having the goods repaired.
The use of the Website and application of these Terms and Conditions are governed by the laws of Australia and such other laws which are applicable in the country where the consumer is resident.
